Mr. Hermann specializes in representing suppliers, materialmen, builders and developers in the maintenance and/or defense of lien claims under the Michigan Construction Lien Act. Notable Case include:

 

Stock Building Supply v. Stephen Rollier Stock Building Supply filed suit against a custom home builder for  materials that were incorporated into  building project which the homeowner failed to pay. In answering the complaint on behalf of the builder Mr. Hermann filed a third-party action against the homeowner under the Construction Lien Act for judicial foreclosure of the property based on his failure to pay for materials that were incorporated into  the property.  The Circuit Court eventually granted the builder’s Motion Summary Disposition entering a judgment against the property owner in the amount of $77,379.27. The judgment amount included $16,000 for services or materials provided in the construction of the home and $61,400 for attorney fees.  The Court of Appeals affirmed the decision of the Circuit Court as to the judgment against Mr. Zawlocki but reversed the Circuit Court’s denial of Mr. Rollier’s claim for $9,632.50 in post judgment interest.

 

In Re Daniel Zawlocki, Mr. Hermann represented a construction lien claimant in a Chapter 13 Bankruptcy Petition filed by a homeowner. In the proceeding, the Debtor sought to disallow the claimant’s construction lien claim. After an evidentiary hearing, United States Bankruptcy Judge Daniel S. Opperman allowed the claimant’s construction lien judgment in the amount of $77,379.27 along with an additional $50,994.26.00 in post judgment attorney fees and costs.
